Limited Workmanship & Materials Warranty
Operating Entity: Create Escape Inc. O/A Calgary Landscaping
Effective Date: October 30, 2026
Governing Standard: Alberta Landscape Construction Standards & Construction Contract Terms
Calgary Landscaping stands behind the quality of our craftsmanship. Our projects are built to withstand Calgary’s unique climate and severe freeze-thaw cycles. This Warranty Policy outlines the coverage, terms, and exclusions applicable to our landscape construction projects.
1. One-Year Limited Workmanship Warranty
Calgary Landscaping provides a one (1) year limited warranty covering defects in workmanship on items directly constructed and installed by our crews:
Commencement Date: The warranty period commences on the official date of Substantial Performance.
Account Standing: Warranty coverage applies provided the project account has been paid in accordance with the executed Landscape Construction Contract.
Correction of Deficiencies: Valid workmanship deficiencies reported during the warranty period will be assessed and corrected by Calgary Landscaping within a commercially reasonable timeframe, subject to seasonal weather conditions.
2. Live Nursery Stock & Plantings (Trees, Shrubs, Sod, Perennials)
To provide direct-from-nursery wholesale pricing without retail markup, Calgary Landscaping acts as a procurement and installation facilitator:
Quality Standard: All nursery stock is sourced from local growers adhering to Canadian Nursery Landscape Association (CNLA) quality standards.
Sold As-Is / No Survival Guarantee: Live plant material (including sod, shrubs, perennials, and trees) is sold as-is with no warranty or survival guarantee.
Mandatory Site Inspection: The property owner must inspect all plant material immediately upon installation. Any unsatisfactory specimen must be brought to our attention before our installation crew mobilizes off-site.
Homeowner Responsibility: Once our crew departs the site, all responsibility for ongoing watering, fertilization, pest control, staking, and climate protection passes entirely to the property owner. We do not offer replacements, refunds, or deadwood removal for perished plantings.
3. Drainage & Lot Grading
Positive Drainage Warranty: We warrant positive surface drainage strictly at the time of Substantial Performance.
Settling & Alterations: Calgary Landscaping bears no liability for water pooling, ice buildup, or grade alterations resulting from post-construction ground settlement, foundation shifting, extreme precipitation exceeding storm design capacity, or third-party site modifications.
Discharge & Subsurface Water: Subsurface water, artesian springs, roof water, and eavestrough discharge fall outside our drainage control and are excluded from warranty coverage.
4. Irrigation Systems & Sub-Zero Temperature Cutoff
Sub-Zero Expiration: The warranty for all water-related installations (irrigation lines, valves, backflow devices, and water features) automatically expires at the first occurrence of sub-zero temperatures (0°C or below) lasting more than two (2) hours, as recorded by the nearest Environment Canada weather station.
Mandatory Winterization: Irrigation systems must be professionally blown out and winterized prior to freezing conditions. Calgary Landscaping does not perform winterization unless contracted under a separate seasonal maintenance agreement.
Voiding Condition: Failure to properly shut down and blow out water systems prior to freezing temperatures immediately and permanently voids all plumbing and irrigation warranties.
5. Product & Material Warranties (Manufacturer Coverage)
Manufacturer Coverage Only: Commercial hardscape materials—including concrete pavers, retaining wall blocks, composite decking, low-voltage transformers, and lighting fixtures—carry the specific warranties provided by their respective manufacturers.
Labor Exclusion: In the event of a product or manufacturing defect, the manufacturer’s warranty governs. Calgary Landscaping assumes no liability for labor, demolition, removal, or reinstallation costs associated with manufacturer material claims.
Natural Material Characteristics: Wood, natural stone, composite lumber, concrete, and painted finishes naturally warp, expand, contract, check, weather, fade, or effloresce over time. These inherent physical characteristics are normal and are expressly excluded from workmanship coverage.
6. General Exclusions & Actions That Void the Warranty
The Workmanship Warranty does not cover, and is automatically voided by, any of the following occurrences:
De-Icing Salts & Harsh Chemicals: The application of sodium chloride (rock salt), chemical de-icers, pool/hot tub backwash, high-nitrogen fertilizers, or non-selective herbicides to stone, concrete, woodwork, or adjacent plantings.
Ground Movement & Natural Events: Soil subsidence, frost heaving, underground sinkholes, high water tables, animal burrowing, hail, severe windstorms, localized flooding, or other natural occurrences.
Third-Party Alterations: Any modification, excavation, construction, or repair performed on or adjacent to our work by the homeowner or other trades.
Weed Growth: We do not warrant against weed germination or airborne seeds in decorative rock, mulch beds, paving joints, or sodded areas. Ongoing weed control remains an ongoing maintenance duty of the property owner.
Account Arrears: Failure to remit contract payments according to the payment milestones outlined in the Landscape Construction Contract.
